Civil Monetary Penalty (CMP) Reinvestment Projects


CMP is a monetary penalty the CMS or the State may impose against nursing facilities when a facility is not in compliance with one or more Medicare and Medicaid participation requirements for long-term care facilities (Code of Federal Regulations (CFR) 42 §488.430, 42 CFR Part 483 subpart B). CMP funds collected from nursing homes are deposited into the Nursing Home Residents’ Trust Fund (RS 40:2009.11(F)(2)) established by Louisiana Legislature in accordance with the OBRA of 1987 (P.L. 100-203).

CMP Reinvestment Projects utilize these funds to support projects that benefit nursing home residents and protect or improve their quality of care or quality of life (per 42 CFR §488.433). The CMP Reinvestment Projects were created as an effort to drive improvements in quality of care for nursing home residents. The program aims to improve quality of life and care by equipping nursing home staff, administrators, and stakeholders with technical tools and assistance to enhance resident care.

Approval Process

Applications are subject to a series of approval steps.  Additional information may be requested from the applicant during each step of the approval process.

Cooperative Endeavor Agreement (CEA)

Upon CMS-CMRP Grant approval, the CEA process begins and will entail several internal reviews.

NOTE: In specific situations, a CF-1 contract is utilized in lieu of a CEA.
