The purpose of this page is provide additional information to prospective processors or distributors of acidified and/or low-acid canned foods. These foods are subject to an additional set of regulatory requirements beyond the good manufacturing practices (21 CFR 110) that must be adhered to by all food manufacturers. Due to several incidents involving Clostridium botulinum intoxications as a result of poorly-processed foods in these categories, FDA implemented a set of rules that require firms to register as processors and to file their processes (21 CFR 108) with FDA. 21 CFR 108 also requires such manufacturers to ensure that employees who oversee these processes have adequate training, generally in the form of an FDA- or university-sponsored better process school.

Commercial body art has been regulated in the state of Louisiana since 1999. Body art is defined by Part XXVIII of Title 51 of the Louisiana Administrative Code as "the practice of physical body adornment by registered establishments and operators utilizing, but not limited to, the following techniques: tattooing, cosmetic tattooing, body piercing, branding, and scarification".

Cosmetics are items that are designed to alter the appearance or enhance the attractiveness of a person. These items are governed under the federal Food, Drug, and Cosmetic Act of 1938 and the Food, Drug and Cosmetic Law (LSA R.S. 40: 601 et seq.). Soap is specifically excluded from the regulatory definition of human cosmetic products. Wholesale manufacturers or distributors of cosmetic products in the state of Louisiana are required to be permitted by the Food and Drug Unit and cosmetics distributed in Louisiana are required to be registered under the department's Product Registration program.

The Food and Drug Unit of the Office of Public Health regulates a variety of activities and processes pertaining to food, drugs, and cosmetics in the state of Louisiana. Regulated facilities include food-manufacturing facilities; drug-manufacturing facilities; food and drug storage warehouses; ice-manufacturing plants; ice-vending units; bottled water facilities; acidified- and low-acid canned foods processors; food banks; breweries; wineries; wholesale producers of value-added seafood products (such as gumbos and etouffees); beef and poultry product storage warehouses; medical-gas manufacturers and trans-fillers; medical-gas distribution facilities; UV tanning facilities; commercial body art (tattooing, permanent makeup, and body piercing) facilities; and water-vending units.

Food manufacturing and processing in Louisiana occurs in a variety of forms, from the bottling of drinking water and soft drinks to the production of such endemic Louisiana staples as gumbos, hot sauces and crawfish pies. All of these activities are regulated by the Food and Drug Unit (FDU) under the authority of the Louisiana Administrative Code (specifically, Part VI of Title 51) and § 601 et seq. of Title 40 of the Louisiana Revised Statutes of 1950 (better known as the State Food, Drug, and Cosmetic Law).

Food storage and distribution facilities are also regulated by the Food and Drug Unit. A permitted food manufacturer usually has a designated warehouse facility attached to or otherwise integrated with the manufacturing operation; these facilities do not require a separate Permit to Operate. However, standalone snack-vending warehouses, multiple-foods warehouses, and other kinds of food distribution facilities do require a "W"-class permit from our office.
