Medical Marijuana Regulation
Introduction
Per Act 491 and Act 492 of the 2022 Regular Legislature, as of August 1, 2022, the Louisiana Department of Health has assumed regulatory authority over Louisiana's medical (therapeutic) marijuana program. LDH personnel are responsible for conducting inspections of medical marijuana production facilities and reviewing finished product test results to verify compliance with the requirements of La. R.S. 40: 1046. While there will be some changes to the way that the program is administered, the department is working with its counterparts at the Louisiana Department of Agriculture and Forestry to ensure a smooth transition.
Act 693 of the 2024 Regular Legislature transferred authority over marijuana dispensaries from the Louisiana Board of Pharmacy to the Louisiana Department of Health. LDH's Cannabis Program began regulating these retail sites on January 1, 2025.
There are two licensed medical-marijuana manufacturers in the state of Louisiana--Advanced Biomedics LLC dba Ilera Holistic Healthcare and Good Day Farm Louisiana LLC. Each batch of product is tested for purity and to ensure that it does not exceed the THC-content levels prescribed by the Legislature. Product that has been tested and accepted by the licensee may be transported to one of the licensed dispensaries in the state for distribution to a consumer. Dispensaries may provide medical marijuana in an approved dosage form to any patient with a valid recommendation from a board-certified Louisiana physician.

- The Louisiana State Board of Medical Examiners (LSBME) no longer tracks or monitors authorized clinicians specifically for the purpose of overseeing the activity of issuing recommendations to qualified patients for medical marijuana. Any authorized clinician as defined in La. R.S. 40: 1046 who is in good standing with the relevant governing board may issue marijuana recommendations.

- Prior to analyzing, testing, or handling therapeutic marijuana in Louisiana, an applicant for a therapeutic marijuana laboratory license shall submit an initial license application to the department.

- Laboratories must provide proof of accreditation by the National Institute on Drug Abuse, the National Environmental Laboratory Accreditation Conference, the International Organization for Standardization, or other accrediting entity approved by the department.
- Laboratories are required to utilize the Louisiana Medical Marijuana Tracking System (LMMTS).
- Laboratories must meet all requirements for a therapeutic marijuana laboratory set forth in ACT 491 and ACT 492 of the 2022 Regular Louisiana Legislative session and La. R.S. 40:1046 (or successor legislation).
