  Intermediate Care Facilities for Persons with Intellectual Disabilities – Rate Determination LAC 50:VII.32903

  Amends the provisions governing intermediate care facilities for persons with intellectual disabilities (ICF/IID) to eliminate the expiration date on an increased per diem rate for ICFs/IID that downsized from over 100 beds to less than 35 beds prior to December 31, 2010, without the benefit of a cooperative endeavor agreement or transitional rate and that incurred excessive capital costs.

  Federally Qualified Health Centers – Alternative Payment Methodology LAC 50:XI.10703

  Amends the provisions governing reimbursement for FQHCs in order to establish an alternative payment methodology to pay an add-on of $50 per encounter in addition to the PPS rate on file for the date of service.

  Eligibility – Medicaid Purchase Plan LAC 50:III.2309

  Allows persons who meet the Social Security disability criteria to seek the employment services, vocational rehabilitation services, and other support services needed to obtain, regain or maintain employment, and reduce their independence on cash benefit programs. Senate Concurrent Resolution 17 of the 2024 Regular Session of the Louisiana Legislature requests that the Department of Health increase eligibility requirements for the Medicaid Purchase Plan. This rulemaking action proposes to increase the income limit for this program from 100 percent to 200 percent of the federal poverty level (FPL), requires premiums for workers with income above 150 percent of FPL and increases the countable resources the worker can own from $10,000 to $25,000.

  Continues the provisions of the September 16, 2024 Emergency Rule, which establishes a reimbursement methodology to ensure that other rural hospitals remain financially viable, so that the access to medical care provided to Medicaid beneficiaries in their communities will continue to be available and will improve in the future.

  Home and Community-Based Services Waivers – Community Choices Waiver LAC 50:XXI.Chapters 81, 85, 86, 93, and 95

  Amends the provisions governing the Community Choices Waiver to add a new priority group, specify the requirements for criminal history background checks and database checks for employees, update the Organized Health Care Delivery System (OHCDS) language to reflect the additional CCW services, revise the reimbursement language to agree with the wage floor requirements, and modify the language regarding direct support/service worker wages, other benefits, and workforce retention bonus payments to indicate that Louisiana Department of Health is no longer establishing the criteria.

  Amends the provisions governing Adult Day Health Care providers in order to incorporate language which allows the department to impose a penalty fee for each month a claim or report is filed or submitted beyond the close of the reporting period.

  Professional Services Program – Reimbursement Methodology LAC 50:IX.15113

  Amends the provisions governing reimbursement methodology in the Professional Services Program in order to allow coverage of physician-administered biosimilar drugs in Mary Bird Perkins Cancer Centers and establish the reimbursement methodology for their use.

  Amends the provisions governing the Pharmacy Benefits Management Program to update copay tier payment schedule to align with the U.S. Department of Health and Human Services, Centers for Medicare and Medicaid Services recommended guidelines.

  Long Term-Personal Care Services LAC 50:XV.Chapter 129

  Amends the provisions governing long term personal care services (LT-PCS) to update language pertaining to rights and responsibilities, cost reporting requirements, and add new language for a rate methodology to align current policies and procedures under the home and community based services waivers with the Louisiana Administrative Code.

  Home and Community-Based Services Waivers – Supports Waiver LAC 50:XXI.Chapters 57 and 59

  Amends the provisions governing the supports waiver services to add assistive technology with remote features to specialized medical equipment, place service limits on assistive technology with remote features and incontinence supplies, include additional requirements for day habilitation and prevocational services providers and require that community life engagement providers must possess a valid adult day care license and provide day habilitation services.

  Home and Community-Based Services Waivers – Support Coordination Standards for Participation LAC 50:XXI.Chapter 5

  Amends the provisions governing Support Coordination Standards for Participation to align the administrative Rule with current policy and procedures under the Home and Community-Based Services (HCBS) Waivers relative to general provisions, administration and organization, provider responsibilities, and to establish cost reporting requirements for support coordination agencies providing waiver services.
