  Home and Community-Based Services Waivers – Adult Day Health Care Waiver – Direct Support Worker Wages and Bonus Payments LAC 50:XXI.Chapter 29

  Continues the provisions of the July 31, 2022 Emergency Rule which adopted provisions governing reimbursement in the Adult Day Health Care (ADHC) Waiver in order to establish a direct wage floor and workforce retention bonus payments for direct support workers at ADHC centers along with audit procedures and sanctions, in compliance with House Concurrent Resolution 127 of the 2021 Regular Session of the Louisiana Legislature.

  Early and Periodic Screening, Diagnosis and Treatment – Health Services – EarlySteps Reimbursement Rate Increase LAC 50:XV.7107

  Continues the provisions of the July 31, 2022 Emergency Rule which amended the provisions governing the Early and Periodic Screening, Diagnosis and Treatment Program in order to increase reimbursement rates paid for certain services rendered to infants and toddlers in the EarlySteps Program, in compliance with Act 199 of the 2022 Regular Session of the Louisiana Legislature.

  Continues the provisions of the July 1, 2022 Emergency Rule which established the criteria for an acute care hospital to qualify as an urban metropolitan statistical area (MSA) facility and the reimbursement methodology for the provision of outpatient services.

  Continues the provisions of the July 1, 2022 Emergency Rule which established the criteria for an acute care hospital to qualify as an urban metropolitan statistical area (MSA) facility and the reimbursement methodology for the provision of inpatient services.

  Behavioral Health Service Providers – Licensing Standards LAC 48:I.Chapters 56 and 57

  Amends the provisions governing the licensing of behavioral health service (BHS) providers regarding employment of peer support specialists, geographic service locations, specialized behavioral health rehabilitation services and establishes requirements for the treatment of opioid use disorder in pregnant women by licensed BHS providers in compliance with Acts 151, 344, 390, 503 and 309 of the 2022 Regular Session of the Louisiana Legislature.

  Applied Behavior Analysis-Based Therapy Services – Place of Service Limitations LAC 50:XV.301

  Continues the provisions of the July 15, 2022 Emergency Rule which amended the provisions governing applied behavior analysis-based (ABA) therapy services in order to remove non-conventional place of service limitations to ensure ABA services can be delivered in a community setting.

  Hospital Licensing Standards – Obstetrical and Newborn Services LAC 48:I.Chapter 93

  Amends the provisions governing the licensing of hospitals in order to update the standards for obstetrical and newborn services and relocate the existing provisions of LAC 48:I.9511-9515 to LAC 48:I.9519-9523 to ensure that the administrative Rule reflects current requirements for staffing and levels of care units.

  Intermediate Care Facilities for Persons with Intellectual Disabilities – Complex Care Reimbursements LAC 50:VII.32915

  Amends the provisions governing reimbursement to private non-state intermediate care facilities for persons with intellectual disabilities (ICFs/IID) in order to revise and streamline the process by which ICFs/IID can request add-on rates for medically qualified beneficiaries receiving above routine care and whose staffing levels exceed the required minimum.

  Hospice Services – Emergency Services and Inpatient Care LAC 50:XV.3503 and 4309

  Amends the provisions governing hospice services in order to: 1) temporarily waive the provision requiring daily visits by the hospice provider to all clients under the age of 21 and allow telemedicine visits as an alternative in the event of a federal or state declared emergency or disaster; and 2) clarify that the five-day limit for inpatient care is applied to respite care only.

  Adopts provisions in the Home Health Program in order to temporarily allow non-physician practitioners to order and review home health services in the event of a federal or state declared emergency or disaster.

  Home Health Program – Durable Medical Equipment – Enteral Formula Reimbursement LAC 50:XIII.10301

  Amends the provisions governing reimbursement for durable medical equipment in the Home Health Program in order to revise the methodology used to set the rates for enteral formulas and allow reimbursement under the standard procedure codes on the Louisiana Medicaid fee schedule.

  Experimental Procedures – Routine Care for Beneficiaries in Clinical Trials LAC 50:I.305

  Amends the provisions governing experimental procedures in order to align the provisions governing routine care for beneficiaries in clinical trials with federal requirements specified in the American Rescue Plan Act.
