Amends the provisions governing the reimbursement methodology for nursing facilities in order to remove a facility that is no longer owned or operated by a non-state governmental organization (NSGO) from the list of NSGO facilities qualified to receive quarterly upper payment limit supplemental payments.
Amends the provisions governing the facility need review (FNR) process in order to allow the department to approve a temporary relocation/transfer of a nursing facility’s Medicaid FNR approvals to another licensed, certified and operational nursing facility outside of the service area or parish while awaiting the completion of a replacement nursing facility building.
Amends the provisions governing licensing standards for crisis receiving centers (CRCs) in order to clarify the language in the administrative Rule and add provisions for emergency preparedness and infection control, optional participation in the Patient Compensation Fund, physical environment requirements, and inactivation of the CRC license due to a non-declared emergency or disaster.
Amends the provisions governing the payment methodology for the dental benefits prepaid ambulatory health plan in order to allow the state to reimburse monthly capitation payments to the dental benefits plan manager (DBPM) in the aggregate on a lump sum basis when necessary, and to require DBPMs to submit medical loss ratio data to the state and issue a refund if minimum standards are not met.
Continues the provisions of the August 25, 2020 Emergency Rule which amended the provisions governing reimbursement for non-state intermediate care facilities for persons with intellectual disabilities in order to increase the rate reimbursement rates to facilities that downsized from over 100 beds to less than 35 beds prior to December 31, 2010 without the benefit of a cooperative endeavor agreement, in compliance with Act 1 of the 2020 First Extraordinary Session of the Louisiana Legislature.
Amends the provisions governing provider enrollment in the non-emergency medical transportation (NEMT) program to increase the minimum liability insurance for providers of transportation to out-of-state medical or behavioral health services in order to comply with the federal requirements for interstate NEMT travel.
Amends the standards for payment for nursing facilities in order to clarify the provisions governing non-emergency transportation for medical appointments.
Amends the provisions governing laboratory and radiology services in order to ensure that the existing language reflects current practices, remove coding and billing instructions and other extraneous information from the administrative Rule, and promulgate these provisions clearly and accurately in the Louisiana Administrative Code.
Amends the provisions governing federally qualified health centers to ensure the language reflects current practices and promulgate these provisions clearly and accurately in the Louisiana Administrative Code, and to remove procedural language from the administrative Rule.
Continues the provisions of the September 21, 2020 Emergency Rule which adopted provisions to allow licensed home and community-based services providers to operate and provide services outside of their licensed geographic areas to existing clients who have evacuated or temporarily relocated to another location in the state due to a gubernatorial declared state of emergency or disaster in Louisiana.
Amends the provisions governing the Professional Services Program in order to remove specific clinical information and procedural language from the administrative Rule to reflect current practices and ensure that the provisions are promulgated clearly and accurately in the Louisiana Administrative Code.
