  Intermediate Care Facilities for Persons with Intellectual Disabilities - Reimbursement Methodology - Direct Care Floor Recoupment LAC 50:VII.32901

  Amends the provisions governing reimbursement for non-state intermediate care facilities for persons with intellectual disabilities in order to establish an effective date for the remittance of funds owed to the department by facilities that fail to meet the required direct care floor and specify that filing an administrative appeal does not suspend or delay the imposition of this recoupment.

  Repeals the Rules governing Kangaroo Pump and Durable Medical Equipment Program - HIPAA Implementation as it has been determined that the provisions of these Rules are procedural requirements that are included in the provider manual.

  Home and Community-Based Services Waivers – Cost Reporting Requirements LAC 50:XXI.Chapters 7 and Chapter 29

  Amends the provisions governing home and community-based services (HCBS) waivers in order to: 1) repeal LAC 50:XXI.Chapter 29 of the Adult Day Health Care Waiver Rule in its entirety and incorporate the language into LAC 50:XXI.Chapter 7 of the general provisions for HCBS waivers providers; 2) add provisions stating that personal care service and adult day health care providers may be penalized for failing to submit cost reports timely; and 3) remove outdated language from the administrative Rule.

  Reimbursement for Vaccine Administration During a Declared Public Health Emergency LAC 50:IX.8305,8505,15113 and XXIX.Chapter 9

  Continues the provisions of the December 23, 2020 and April 20, 2021 Emergency Rules, which amend the provisions governing reimbursement in the Professional Services and Pharmacy programs in order to adopt provisions governing vaccine administration during a declared public health emergency.

  Home and Community-Based Services Waivers – Support Coordination Standards for Participation LAC 50:XXI.501

  Amends the provisions governing the standards for participation for providers of support coordination services under home and community-based services waivers administered by the Office of Aging and Adult Services (OAAS) in order to remove outdated language and to allow OAAS to temporarily perform some of the mandatory duties of the support coordination agencies when necessary to ensure participant health and welfare and continuity of services.

  Home and Community-Based Services Waivers – Community Choices Waiver LAC 50:XXI.Chapters 83 and 95

  Amends the provisions governing the Community Choices Waiver in order to: 1) clarify that instrumental activities of daily living can be provided outside of the participant's home, if approved by OAAS or its designee on a case-by-case basis; 2) remove language regarding relatives that can be direct service workers (DSWs); 3) remove respiratory therapy as a service; 4) clarify the language regarding payment of DSWs at least at the current federal or state minimum hourly wage; and 5) add language regarding the state’s authority to set and change provider rates and/or provide lump sum payments to providers based upon funds allocated by the legislature.

  School-Based Health Services LAC 50:XV.Chapter 95

  Amends the provisions governing school-based health services in order to add language to the Louisiana Administrative Code detailing the requirements for cost settlement, filing and submitting cost reports, penalties for late submissions, required documentation and reimbursement, and describe the process for random moment time studies.

  Medicaid Eligibility – Twelve-Month Continuous Eligibility LAC 50:III.2525

  Amends the provisions governing eligibility for the Medical Assistance Program to update the list of recipients under age 19 for whom twelve months of continuous eligibility is not available in order to align the exceptions in the administrative Rule with those currently used for Medicaid eligibility determinations.

  Amends the provisions governing long-term personal care services (LT-PCS) in order to: 1) clarify that instrumental activities of daily living can be provided outside of the participant's home, if approved; 2) remove language regarding relatives that can be direct service workers (DSWs); 3) remove language requiring documentation of place of service in hardcopy service logs; 4) clarify language regarding payment of DSWs at least at the current federal or state minimum hourly wage; and 5) add language regarding the state’s authority to set and change LT-PCS rates and/or provide lump sum payments to providers based upon funds allocated by the legislature.

  Intermediate Care Facilities for Persons with Intellectual Disabilities – Temporary Reimbursement for Private Facilities LAC 50:VII.32904

  Continues the provisions of the February 1, 2021 Emergency Rule which adopted provisions governing the temporary rates for intermediate care facilities for persons with intellectual disabilities (ICFs/IID) that have a cooperative endeavor agreement with the Office for Citizens with Developmental Disabilities and have a high concentration of people who have intellectual/developmental disabilities, significant behavioral health needs, and high risk behavior resulting in previous interface with the judicial system, and for whom no other private ICFs/IID provider is able to support.

  Professional Services Program—Reimbursement Methodology LAC 50:IX.Chapter 151

  Amends the provisions governing the Professional Services Program in order to remove information related to programs no longer in operation, remove provisions that are located in other places within the Louisiana Administrative Code, clarify the reimbursement methodology for certain providers and services, and to provide for a rate restoration related to neonatal critical care services.

  Nursing Facilities—Supplemental Payments - Non-State Governmental Organizations LAC 50:II.20029

  Amends the provisions governing the reimbursement methodology for nursing facilities in order to remove a facility that is no longer owned or operated by a non-state governmental organization (NSGO) from the list of NSGO facilities qualified to receive quarterly upper payment limit supplemental payments.
