  Home and Community-Based Services Waivers – New Opportunities Waiver-Individual and Family Support Payments LAC 50:XXI.13701,13902,13927,13933, and 14301

  Amends the provisions governing the New Opportunities Waiver in order to change the complex care service to a supplemental payment and to update skilled nursing provider qualifications to reflect the current licensing requirements. This change is necessary based on Centers for Medicare and Medicaid Services (CMS) guidance and the decision by CMS to not approve complex care as a service.

  Adult Mental Health Services – Peer Support Services LAC 50:XXXIII.6307

  Amends the provisions governing adult mental health services in order to add peer support services as a covered service in compliance with Senate Concurrent Resolution 84 of the 2019 Regular Session of the Louisiana Register and an agreement with the United States Department of Justice.

  Act 421 Children’s Medicaid Option LAC 50:XXII.Chapters 81-85

  Adopts provisions to establish the Act 421 Children’s Medicaid Option program as a Section 1115 demonstration waiver in compliance with Act 421 of the 2019 Regular Session of the Louisiana Legislature.

  Hospice Services - Pediatric Concurrent Care LAC 50:XV.3503 and 4315

  Amends the provisions governing hospice services provided concurrently with life-prolonging treatments to individuals under age 21 in order to update existing terminology and reflect current practices, comply with federal requirements which allow for pediatric concurrent care, and promulgate these provisions clearly and accurately in the Louisiana Administrative Code.

  Behavioral Health Services - Substance Use Disorders Services LAC 50:XXXIII.14501

  Amends the provisions governing substance use disorders services provider participation in order to align the responsibilities for providers of these services with provider requirements for behavioral health services and to repeal redundant or procedural language from the administrative Rule.

  Out-of-State Medical Services LAC 50:I.701

  Amends the provisions governing out-of-state medical services in order to reflect current practices and to align the administrative Rule with Centers for Medicare and Medicaid Services regulations regarding out-of-state care.

  Nursing Facilities – Licensing Standards LAC 48:I.9701 and 9943

  Amends the provisions governing the licensing of nursing facilities in order to align reporting requirements for state licensed nursing facilities with national requirements and provide standardized information to assist with national surveillance on the status of Coronavirus Disease 2019 (COVID-19) in all nursing facilities.

  Medicaid Eligibility - Qualified Disabled and Working Individual Program Resources LAC 50:III.10703 and 10705

  Amends the provisions governing the counting of resources in determining eligibility for the Qualified Disabled and Working Individual Program in order to align the administrative Rule with the current Medicaid State Plan and Centers for Medicare and Medicaid Services regulations.

  End Stage Renal Disease Facilities – Reimbursement for Independent Laboratory Services LAC 50:XI.6901

  Amends the provisions governing reimbursement for end stage renal disease (ESRD) facilities in order to allow contracted independent laboratories to bill the Medicaid program directly for the provision of covered non-routine laboratory services instead of receiving reimbursement from the ESRD facility.

  Dental Benefits Prepaid Ambulatory Health Plan (LAC 50:I.Chapter 21)

  Amends the provisions governing the dental benefits prepaid ambulatory health plan in order to allow for more than one dental benefits plan manager to service Medicaid enrollees and to allow for the department to contract with a vendor for enrollment broker services for member enrollment into one of the available plans.

  Inpatient Hospital Services – Coverage of Donor Human Breast Milk LAC 50:V.111

  Adopts provisions governing reimbursement outside of the inpatient hospital per diem for donor human breast milk provided to hospitalized premature newborns in order to ensure access to an effective treatment to reduce the incidence of severe complications.

  Pregnant Women Extended Services - Tobacco Cessation Counseling LAC 50:XV.16303

  Amends the provisions governing tobacco cessation counseling for pregnant women in order to allow additional sessions in excess of established service limits when deemed medically necessary.
