RULEMAKING: Public Health - Final Rule

This Rule adds Spinal Muscular Atrophy (SMA), Mucopolysaccharidosis (MPS I), and Glycogen Storage Diseases Type II (Pompe Disease) to the Louisiana Newborn Screening Panel.

This rule amends §701 of Chapter 7 of Title 51—Public Health Immunization Requirements. The amendments add vaccines for SARS-CoV-2 to the list of required vaccinations for school entry to the extent that such vaccines are approved by the Food and Drug Administration for the individual’s age, and also require such vaccines, and all potential boosters, on the same basis for school attendance.

Under the authority of R.S. 36:254(B)(7) and in accordance with R.S. 49:950 et seq., the Administrative Procedure Act, the Department of Health, Office of Public Health (LDH-OPH), has amended Chapter 80 (Accreditation of Laboratories Performing Drinking Water Analyses) of Subpart 28 (Drinking Water Laboratories) of Part V (Preventive Health Services) of Title 48 (Public Health?General) of the Louisiana Administrative Code (LAC). The amendments are necessary to withdraw the LDH-OPH Laboratory Certification Program from The NELAC Institute (TNI), the National Environmental Laboratory Accreditation Program (NELAP).

Under the authority of R.S. 40:4 and 40:5, and in accordance with R.S. 49:950 et seq., the Administrative Procedure Act, the state health officer, acting through the Louisiana Department of Health, Office of Public Health (LDH-OPH), has amended certain sections of Chapter 5 (Registration of Foods, Drugs, Cosmetics and Prophylactic Devices) of Title 49 (Public Health—Food, Drugs, and Cosmetics) and Section 301 of Part VI (Manufacturing, Processing, Packing and Holding of Food, Drugs, and Cosmetics) of Title 51 (Public Health-Sanitary Code) of the Louisiana Administrative Code.

In accordance with the Louisiana Administrative Procedure Act, R.S. 49:950 et seq., the state health officer, acting through the Louisiana Department of Health, Office of Public Health has adopted LAC 48:I.Chapter 6, Uses and Disclosures of Information for Public Health Emergency Preparedness Activities. R.S. 40:4 and R.S. 40:5 authorize the state health officer acting through the Office of Public Health of the Louisiana Department of Health to prepare, promulgate, and enforce rules and regulations related to public health in the state of Louisiana.

Under the authority of R.S. 40:4 and 40:5, and in accordance with R.S. 49:950 et seq., the Administrative Procedure Act, the state health officer, acting through the Louisiana Department of Health, Office of Public Health (LDH-OPH), has amended Part VII (Dairy Products Regulations) of Title 51 (Public Health—Sanitary Code). These amendments update sampling requirements for certain dairy product businesses that freeze or partially freeze and repackage frozen desserts made from frozen dessert mixes that were pasteurized, ultra pasteurized or aseptically processed at another plant for wholesale.
