  EMERGENCY RULE: Minimum Disinfectant Residual Levels in Public Water Systems

  In accordance with the provisions of the Administrative Procedure Act, (R.S. 49:950, et seq.), the Department of Health and Hospitals (DHH) is renewing the emergency rule that amends Chapter 3 (Water Quality Standards), Chapter 9 (Louisiana Total Coliform Rule), Chapter 11 (Surface Water Treatment Rule) and Chapter 15 (Approved Chemical Laboratories/Drinking Water) of Part XII (Water Supplies) of Title 51 (Public Health?Sanitary Code) of the Louisiana Administrative Code (LAC). This action is being taken pursuant to the emergency rulemaking authority granted by R.S. 40:4(A)(13) and in accordance with the intent of Act 573 of 2014. Jimmy Guidry, M.D., State Health Officer, and I have determined that this Emergency Rule is necessary to avoid an imminent peril to the public health and safety. The DHH finds it necessary to renew the emergency rule. The emergency rule makes changes to LAC 51:XII.Chapters 3, 9, 11 and 15 regarding the need to increase the minimum disinfectant residual levels and measurements required to be maintained and taken by public water systems.

  The Department of Health and Hospitals, Bureau of Health Services Financing has submitted Final Rules to the Office of the State Register for publication in the October 20, 2015 edition of the Louisiana Register in accordance with the provisions of the Administrative Procedure Act, R.S. 49:950 et seq. Prior submissions are available in the archives.

  Early and Periodic Screening, Diagnosis and Treatment - School-Based Nursing Services (LAC 50:XV.9501)

  Continues the provisions of the July 1, 2015 Emergency Rule which amended the provisions governing school-based nursing services covered in the EPSDT Program to remove the IEP requirement.

  Home and Community-Based Services Providers – Licensing Standards (LAC 48:I.Chapters 50 and 51)

  Continues the provisions of the November 20, 2014 Emergency Rule which amended the provisions governing the licensing standards for HCBS providers to clarify these provisions and to include licensing provisions for monitored in-home caregiving services.

  Inpatient Hospital Services – Non-Rural, Non-State Hospitals - Reinstatement of Additional Payments for Hemophilia Blood Products (LAC 50:V.965)

  Continues the provisions of the July 1, 2015 Emergency Rule which amended the provisions governing the reimbursement methodology for inpatient hospital services rendered by non-rural, non-state hospitals to reinstate reimbursements for costs incurred in the purchase of blood products for certain Medicaid recipients diagnosed with, and receiving inpatient treatment for, hemophilia.

  Inpatient Hospital Services - Public-Private Partnerships - Reimbursement Methodology (LAC 50:V.1703)

  Continues the provisions of the July 20, 2013 Emergency Rule which amended the provisions of the April 15, 2013 Emergency Rule in order to revise the formatting of these provisions as a result of the promulgation of the June 1, 2013 Emergency Rule to assure that these provisions are promulgated in a clear and concise manner in the Louisiana Administrative Code.

  Inpatient Hospital Services - Public Private Partnerships - Supplemental Payments (LAC 50:V.Chapter 17)

  Continues the provisions of the November 1, 2012 Emergency Rule which amended the provisions governing inpatient hospital services to establish supplemental Medicaid payments to non-state owned hospitals in order to encourage them to take over the operation and management of state-owned and operated hospitals that have terminated or reduced services.

  Nursing Facilities – Reimbursement Methodology (LAC 50:II.20001)

  Continues the provisions of the July 11, 2015 Emergency Rule which amended the provisions governing the reimbursement methodology for nursing facilities in order to suspend the provisions of LAC 50:II.Chapter 200, and to impose provisions to ensure that the rates in effect do not increase for the SFY 2016 rating period.

  Outpatient Hospital Services - Public-Private Partnerships - Supplemental Payments (LAC 50:V.Chapter 67)

  Continues the provisions of the March 2, 2013 Emergency Rule which amended the provisions of the November 1, 2012 Emergency Rule to revise the reimbursement methodology in order to correct the federal citation.

  Pharmacy Benefits Management Program - State Supplemental Rebate Agreement Program (LAC 50:XXIX.Chapter 11)

  Continues the provisions of the February 22, 2014 Emergency Rule which assures compliance with the technical requirements of R.S. 49:953, and continues the provisions of the October 1, 2013 Emergency Rule governing the Pharmacy Benefits Management Program which established provisions for the Medicaid Program’s participation in The Optimal PDL $olution (TOP$) State Supplemental Rebate Agreement Program.

  Psychiatric Residential Treatment Facilities - Licensing Standards (LAC 48:I.Chapter 90)

  Continues the provisions of the March 20, 2015 Emergency Rule which amended the provisions of the August 20, 2014 Emergency Rule which amended the provisions governing the licensing standards for PRTFs in order to remove service barriers, clarify appeal opportunities, avoid a reduction in occupancy of PRTFs in rural locations, and clarify the process for cessation of business in order to revise the formatting of these provisions to ensure that these provisions are appropriately promulgated in a clear and concise manner.
