Medical Marijuana
Per Act 491 and Act 492 of the 2022 Regular Legislature, as of August 1, 2022, the Louisiana Department of Health has assumed regulatory authority over Louisiana's medical (therapeutic) marijuana program. LDH personnel are responsible for conducting inspections of medical marijuana production facilities and reviewing finished product test results to verify compliance with the requirements of La. R.S. 40: 1046. While there will be some changes to the way that the program is administered, the department is working with its counterparts at the Louisiana Department of Agriculture and Forestry to ensure a smooth transition.
Act 693 of the 2024 Regular Legislature transferred authority over marijuana dispensaries from the Louisiana Board of Pharmacy to the Louisiana Department of Health. LDH's Cannabis Program began regulating these retail sites on January 1, 2025. A Potpourri amending the department's proposed Act 693 rules was published on January 20, 2025.
There are two licensed medical marijuana manufacturers in the state of Louisiana--Advanced Biomedics LLC dba Ilera Holistic Healthcare and Good Day Farm Louisiana LLC. Each batch of product is tested for purity and to ensure that it does not exceed the THC-content levels prescribed by the Legislature. Product that has been tested and accepted by the licensee may be transported to one of the licensed dispensaries in the state for distribution to a consumer. Dispensaries may provide medical marijuana in an approved dosage form to any patient with a valid recommendation from a board-certified Louisiana physician.

- If you are a patient looking for a medical-marijuana recommendation (prescription), contact an authorized clinician. No state agency maintains a list or directory of clinicians recommending marijuana to patients presently. If you are looking for a dispensary in your region, please see the bottom of this page.
- The Louisiana State Board of Medical Examiners (LSBME) no longer tracks or monitors authorized clinicians specifically for the purpose of overseeing the activity of issuing recommendations to qualified patients for medical marijuana. Any authorized clinician as defined in La. R.S. 40: 1046 who is in good standing with the relevant governing board, may issue marijuana recommendations.
- The Emergency Rule published in the April 2025 Louisiana Register is effective on March 28, 2025 and its provisions are summarized below:
- Added a new Subpart to address retailers of medical marijuana, the regulation of which was transferred to the Louisiana Department of Health on January 1, 2025:
- Retailers are now referenced as such and not as "dispensaries"
- Retailers may only sell marijuana products manufactured by firms licensed in Louisiana
- Retail permits remain limited to 10 sites with two possible satellite locations each
- Patients remain restricted to 71g of marijuana flower per 14-day period
- Retailers may not deliver to addresses located outside of the state of Louisiana
- Authorized clinicians must be licensed by and in good standing with the relevant licensing board (Louisiana State Board of Medical Examiners or the Louisiana State Board of Nursing)
- Recommendations must bear an expiration date not to exceed 12 months from the date of issuance
- Removed language referencing permitting of manufacturers and requiring that licenses be issued to Southern University and Louisiana State University; licenses were transferred to the former permit-holders contracted by the universities in 2024
- Changed the regulatory threshold for mold/yeast from 10,000 colony-forming units per gram (CFU/g) to 100,000 CFU/g
- Altered the pesticide testing schedule for marijuana to mirror the one utilized by the state of Oregon
- Added a new Subpart to address retailers of medical marijuana, the regulation of which was transferred to the Louisiana Department of Health on January 1, 2025:

- Laboratories must provide proof of accreditation by the National Institute on Drug Abuse, the National Environmental Laboratory Accreditation Conference, the International Organization for Standardization, or other accrediting entity approved by the department.
- Laboratories are required to utilize the Louisiana Medical Marijuana Tracking System (LMMTS).
