Repeals the provisions of LAC 50:XV.Subpart 11 governing personal assistant services in its entirety since employment support was never implemented.
Amends the provisions governing the standards for payment for nursing facilities in order to: 1) reflect the change in the current assessment tool utilized for level of care determinations; and 2) modify the pathway criteria language in order to include updated terminology contained within the new assessment tool.
Continues the provisions of the April 1, 2022 Emergency Rule which amended the provisions governing temporary reimbursement for private non-state intermediate care facilities for persons with intellectual disabilities in order to include a direct care add-on for increased costs related to retaining and hiring direct care staff and to establish a minimum hourly wage for direct care workers.
Repeals the provisions of LAC 48:I.Chapter 67 governing the licensing of hospitals in its entirety as these provisions are incorporated elsewhere in the Louisiana Administrative Code and replaces it with provisions governing the licensing of free-standing birth centers.
Amends the provisions governing the licensing of ambulatory surgical centers in order to update the requirements for transfer agreements from ASCs to licensed hospitals in the event of an emergency that requires hospital admission.
Amends the provisions governing the licensing of adult day health care (ADHC) providers in order to update the assessment tool used to determine nursing facility level of care eligibility for ADHC admissions.
Continues the provisions of the February 10, 2022 Emergency Rule which amended the provisions governing outpatient hospital services in order to provide reimbursement for laboratory testing for Coronavirus Disease 2019 (COVID-19) separately from outpatient hospital surgery fee schedule payments. In addition, this proposed Rule repeals outdated uncodified outpatient hospital rules and amends the provisions governing reimbursement to out-of-state hospitals to ensure consistency with in-state rates.
Amends the provisions governing the licensing of home health agencies in order to: 1) expand the type of practitioners and qualifications for administrators; 2) update and clarify definitions, the governing body and patient rights provisions, and licensing requirements; and 3) add quality assessment and performance improvement requirements in compliance with Act 181 of the 2021 Regular Session of the Louisiana Legislature.
Continues the provisions of the March 16, 2020 and April 20, 2022 Emergency Rules which allowed coverage of telemedicine/telehealth services provided through an interactive audio system, without the requirement of video in the event of a declared emergency or disaster, and updates the provisions governing telemedicine/telehealth in the Louisiana Administrative Code.
Continues the provisions of the February 4, 2022 Emergency Rule which amended the provisions governing the Pharmacy Benefits Management Program in order to include coverage for over-the-counter at-home tests for Coronavirus Disease 2019 (COVID-19) authorized by the Food and Drug Administration in compliance with requirements of the U.S. Department of Health and Human Services, Centers for Medicare and Medicaid Services.
Amends the provisions governing reimbursement to non-state intermediate care facilities for persons with intellectual disabilities in order to implement administrative penalties related to noncompliance with the direct care floor requirements.
Amends the provisions governing the licensing of hospitals in order to: 1) allow visitation by members of the clergy during a declared public health emergency, 2) ensure proper electronic coding and tracking of post-abortion complications, 3) require hospitals to submit a report on patients who present for post-abortion complication emergency treatment, and 4) ensure that hospital staff members attempt to obtain the required patient information prior to discharge, in compliance with Act 30 of the 2020 Second Extraordinary Session and Act 425 of the 2021 Regular Session of the Louisiana Legislature.
