Amends the provisions governing reimbursement in the Children's Choice Waiver in order to establish a wage floor for direct support workers along with audit procedures, sanctions, and penalties in compliance with Act 119 and House Concurrent Resolution 127 of the 2021 Regular Session of the Louisiana Legislature.
Considering the devastating impacts and effects of Hurricane Ida on the residents of Louisiana, and the need to coordinate care, services, treatment, and placement for evacuees, Louisiana will allow for the following current relief to ICF/DDs.
Amends the December 23, 2020 Emergency Rule which amended reimbursement in the Professional Services and Pharmacy programs to adopt provisions governing vaccine administration during a declared public health emergency (PHE), in order to add language specifying the requirement for Medicaid reimbursement to pharmacies for administration of vaccines related to the PHE.
Amends the provisions of the December 3, 2016 Emergency Rule, which amended the provisions governing outpatient abortion facilities in order to comply with Acts 97, 563 and 593 of the 2016 Regular Session of the Louisiana Legislature which increased the time period for pre-operative services, mandated the distribution of printed information about services for pregnant women, and established provisions for the disposal of fetal remains, in order to amend provisions governing the length of retention of the certification of minors and the disposition of fetal remains.
Rescinds the February 1, 2021 Emergency Rule which amended the provisions governing temporary rates for intermediate care facilities for persons with intellectual disabilities
Adopts provisions governing temporary rates for intermediate care facilities for persons with intellectual disabilities (ICFs/IID) that have a cooperative endeavor agreement with the Office for Citizens with Developmental Disabilities and have a high concentration of people who have intellectual/developmental disabilities, significant behavioral health needs, and high risk behavior resulting in previous interface with the judicial system, and for whom no other private ICFs/IID provider is able to support.

Amends the provisions of the October 19, 2020 Emergency Rule which amended the provisions of the Emergency Rule adopted April 8, 2020 and Title 50 of the Louisiana Administrative Code throughout the duration of the Coronavirus Disease 2019 (COVID-19) public health emergency declaration in order to remove provisions allowing self-attestation of certain eligibility criteria information.
Amends the provisions of the Emergency Rule adopted on April 8, 2020 and Title 50 of the Louisiana Administrative Code throughout the duration of the Coronavirus Disease 2019 (COVID-19) public health emergency declaration in order to require an attestation for adult day center providers to receive retainer payments.
Adopts provisions to allow licensed home and community-based services providers to operate outside of their licensed geographic areas in the event of a gubernatorial declared state of emergency or disaster in Louisiana.
Amends the provisions governing reimbursement for non-state intermediate care facilities for persons with intellectual disabilities in order to increase the rate reimbursement rates to facilities that downsized from over 100 beds to less than 35 beds prior to December 31, 2010 without the benefit of a cooperative endeavor agreement, in compliance with Act 1 of the 2020 First Extraordinary Session of the Louisiana Legislature.
Amends the provisions governing the Adult Day Health Care Waiver, the Community Choices Waiver, and Long-Term Personal Care Services throughout the Coronavirus Disease 2019 (COVID-19) public health emergency declaration, and clarifies that the Home and Community-Based Services waiver provisions which correspond to Louisiana's section 1915(c) Appendix K waiver will remain in effect for the duration of the Emergency Rules published in the April 20, 2020 edition of the Louisiana Register or until the Appendix K waiver termination date of January 26, 2021, whichever is later.
